How many penalty points can be imposed for a speeding offence?
A fixed penalty speeding offence will attract 3 penalty points. Any other speeding offence carries 3-6 points and a discretionary power to disqualify the driver depending on the Court’s view of the seriousness of the individual speeding offence.
How many points accrued will lead to disqualification?
A person will be liable to disqualification if he or she incurs a total of 12 relevant points.
Relevant points are points which are incurred for offences committed within a period of three years. It is important to distinguish between the date of offence and the date of conviction.
How are penalty points removed?
A disqualification for accumulating 12 or more penalty points will remove all penalty points from the licence.
If I accrue 12 penalty points how long will I be disqualified for?
A person will usually be disqualified for a minimum period of six months.
What is the position in relation to the use of mobile telephones in cars?
An offence is committed by a person who uses a handheld mobile phone whilst driving a motor vehicle on a road. The definition of “handheld” is if it is actually held or needs to be held during the course of making or receiving a call or carrying out any other interactive communication function. A handheld device other than a mobile phone is a device which performs an interactive communication function by transmitting or receiving data. This can include sending or receiving faxes or pictures, receiving messages or providing access to the internet. Whilst there does not appear to be any case law on satellite navigation systems it would appear that use of these whilst driving could potentially fall foul of the relevant legislation.
