We act for lenders in a broad range of transactions, and on occasion will also act for both the lender and the borrower at the same time.
This may involve working on a single property deal, or alternatively advising a lender in relation to the refinancing of a property portfolio consisting of multiple properties.
Typically a lender will want to be confident that their lending criteria have been satisfied, and that there are no issues which have arisen during our review of the property documentation which may affect their security over the property. We will work towards finding a practical solution to any issues which are revealed by our due diligence exercise, in order to satisfy both the bank's requirements and if applicable any practical issues which may concern the borrower.
If acting for the borrower as well as the lender we will also ensure that they receive full advice in relation to the nature of the security documentation, including mortgages, debentures, guarantees and cross guarantees, inter-creditor documentation and facility documentation. Our team is accustomed to working to time strict constraints, in particular to meeting facility deadlines.
