Consumer and Retail Disputes

If you are involved in a dispute, whether you are a retailer or consumer, you should speak to a solicitor for specialist legal advice on how to resolve it with minimum damage.

Our experienced dispute management team understands the risks of claims - by both businesses and consumers - faced by retail businesses of all types and sizes.

To speak to a solicitor about a dispute, contact our Leeds, Sheffield or York office by calling 0333 323 5292 or by filling in our enquiry form and letting us know a suitable time to get back to you.

For Retailers

We are very experienced in providing instant access to advice for branch and shop managers, so that problems are 'nipped in the bud' before they can escalate. When consumer or other claims arise, we will help you to resolve them in accordance with the needs of your business, quickly and effectively, with the minimum disruption to your operations and your brand.

More often than not, we will recommend a quicker commercial solution, which may avoid a claim escalating altogether. If the consumer persists unreasonably then we will defend you.

For Consumers

We are highly responsive to the needs of consumers, and will provide cost-effective advice and representation in pursuing claims. We can try to persuade the retailer to take certain steps, such as issue a refund or exchange, or pay compensation where appropriate.

For reasons of cost proportionality, we are unlikely to take on low value claims by a consumer (e.g. over a defective electrical item).

We offer specialist advice on the options available to them in disputes arising out of contracts for the following:

  • Auctions
  • Contracts with insolvent traders
  • Credit purchases
  • Distance selling regulations
  • Sale of goods
  • Supply of services

We have considerable experience in assisting consumers with litigation where remedies are sought against traders including rejection, repair or replacement of (usually high value) goods, and compensation for damage caused by faulty goods.

The Team

We have been advising a wide range of retail businesses over many years. We act for a number of household named brands as well as many smaller businesses. Our experience covers business to consumer and business to business claims across all types of retail activity.

All of our solicitors display Lupton Fawcett’s key values, for example, treating each client as an individual rather than just another case. This means we are able to build genuine relationships with our clients where we shall aim to surpass your expectations.
