Case study: hit by a Car on the Hard Shoulder of a Motorway

We acted for a Claimant who had suffered a massive leg trauma when she was struck by another vehicle when she stopped on the hard shoulder to assist at the scene of an accident. There were allegations of contributory negligence eventually agreed at 90/10 in the Claimant's favour. There was a severe degloving injury to the right leg and fracture of the right femur which also affected the knee joint. The Claimant required 11 operations despite which she was left with significant scarring, pain and some loss of mobility and a 3cm leg length discrepancy. She also suffered Post Traumatic Stress Disorder which required lengthy treatment with some symptoms persisting on a permanent basis. She was unable to return to her pre-accident employment. She would require some adaptations and/or alternative accommodation in the future. Multi-disciplinary experts were required on both sides. The Claimant developed breast cancer during the course of the Claim as a result of which the Defendants raised issues as to life expectancy. The case was settled after 6 years and shortly before trial for £294,500.

Case study: multiple injuries
