Disputes - breach of duty of Good Faith

We acted on behalf of two members of a Surveying and Project Management LLP, where the third member, in breach of his duty of good faith to the other two members, had wrongly tried to influence solicitors instructed by all three members of the LLP to make the LLP Agreement partisan towards him. Ultimately, the third member resigned from the LLP, but first withdrew a six figure sum directly from the LLP’s bank account without consent. Due to our swift and effective intervention including with the bank, the monies withdrawn were successfully recovered in full without issue of proceedings.
