What is a Tax Dispute?
A tax dispute typically arises when a person or business disagrees with a decision made by HMRC. Issues that fall under this category include:
- Tax appeals on all direct and indirect taxes
- Tax indemnity claims
Whatever tax dispute you are involved in, our solicitors have the experience to help you and can guide you to a satisfying resolution.

We always aim to surpass our client’s expectations. To achieve this, we ensure that our services are tailored towards the individual needs of your business. What’s more, our solicitors have a reputation for being friendly yet straight-talking and forward-thinking, so you can be sure you are in safe hands with Lupton Fawcett.
Tax Dispute Resolution
A tax dispute can be resolved in one of two ways:
- Alternative dispute resolution (settling a dispute out of the courtroom with a third-party mediator)
- Court ruling (settling a dispute in the courtroom)
Before a case can go to court, both the HMRC and the opposing party should try to come to an agreement using an independent third party. This third party must be neutral to both sides and will help both the business and the HMRC come to an agreement. If an agreement cannot be reached, the case will go to court where a judge will make a ruling.
As well as assisting in the effective resolution of any tax disputes, our trusted advisers can provide you with all the help and advice you need when considering tax planning arrangements. Therefore, we are happy to provide you with a second opinion on planning structures – either pre-implementation or, if the structure is challenged and you are considering your next steps, post-implementation.
