A party who fails to comply with an Injunction may be sent to prison, or fined, or have their assets seized.
Why seek an Injunction?
An injunction order allows the Court to preserve the status quo until a dispute is resolved. It is often sought where money damages would be of little benefit. For example, where one party has taken confidential information and there is a real risk they will use it for their own benefit.
There are many reasons for seeking an Injunction. We have recently been involved in cases relating to the breach of restrictive covenants, the taking of confidential information, the repeated trespass over land and the prevention of the presentation of a Winding Up Petition.
