What is TUPE?
TUPE protects employees if the owner of a UK-based business changes hands or if a business or organisation decides to outsource part of its function and/or operation to a third party.
TUPE protects all employees regardless of the size of the business. Employees automatically transfer to the new employer on their existing terms and conditions of employment.
How We Can Help
We are able to assist businesses in identifying when a TUPE situation will arise and the steps that they need to take in order to ensure full compliance with the TUPE regulations, including advice in relation to the requirement to inform and consult with employees and recognized Trade Unions or employee representatives.
We are also able to use our experience and understanding of this area of the law to advise clients in relation to the steps that can be taken to minimise the potential for TUPE to apply.
Our lawyers are also frequently called upon to assist clients who are negotiating outsourcing contracts in order to ensure that their exposure to TUPE-related claims at the end of a contract is minimised and that adequate and effective business-to-business indemnities are obtained.
