Case study: cycle accident caused by a damaged service hatch

We were instructed in a claim against the Local Authority and a Telecommunications Company jointly for personal injury suffered when the Claimant cycled over a damaged service hatch on the public highway and was injured. Liability was admitted jointly by the defendants post-issue, but a dispute arose in the medical evidence over the extent of injury prevailing and whether or not there was a chronic pain issue. The case involved an appeal against a case management decision but unfortunately, the Claimant was unable to adduce evidence of the pain condition. The Defendant sought to raise credibility issues late in the day, but a settlement was eventually agreed on an economic basis – agreed settlement £10,000.
