About Notices of Intended Prosecution/Request for Driver Details

As the police are not required to stop every driver suspected of committing a motoring offence, you may be made aware of allegations by a Notice of Intended Prosecution (NIP). This is a written warning that you are going to be facing a prosecution soon. It is therefore vital that if you receive one, you should get in touch with Lupton Fawcett defence team immediately.

The NIP must be sent to the driver or registered owner of a vehicle so that it is received within the normal course of post within 14 days of an alleged offence. If you did not receive your NIP within 14 days, please contact us as there is a good chance you may be able to avoid a fixed penalty or prosecution.

If you did receive the NIP on time, and you are requested to confirm driver details, you then have 28 days to reply and confirm who the driver was at the time of the alleged offence. Failure to comply can lead to additional penalties, including disqualification from driving, penalty points on your licence and a fine of £1,000 or more.

For advice on what to do upon receipt of an NIP and/or request for driver details, please get in touch with the motoring offence team.

Motoring offence penalties

Penalties, including points, a fine or a ban, can have serious effects on your life:

  • Points can result in higher insurance premiums for at least the three years they are on your licence – some insurance penalise you for five years or more
  • A large fine can cause you financial difficulties
  • A disqualification can result in loss of employment or hinder your livelihood

For details on specific penalties for certain offences, take a look at the penalty table from the Department for Transport.

Jeremy (Scott), I just wanted to thank you for today. I think your presence with me at the police station really helped, and lead to the charges being dropped.

Thank you once again for all your help (Jeremy Scott) and support through, what was, an extremely stressful time and also for achieving such a positive outcome for myself. I honestly thought I would get 8 points and a huge fine, so that was a massive relief.

Thank you Meghan for all your help - we obviously did a good job between us to get the result. I am ever so pleased you represented me as I felt very cared for throughout the whole process - thank you once again .

Thank you for your support (Meghan Waldron) and for keeping the cost to a minimum. We truly appreciate your thoughtfulness in this case.

Thank you Meghan for your advice and support in putting my case forward in such a way that the magistrates took account of my condition, and as a result, gave me a manageable penalty.

I have wanted to let you know since the start how very professional and brilliant you were in representing my husband. It was me who initially rang around making enquiries with various reputable law firms for representation and it was you who stood out amongst all the solicitors I spoke to. Very professional and knowledgeable, attentive and great client relation skills. You have a very good asset there.

Thank you for all the support that you have given us. I really do appreciate it. I don't think we would be getting through this without you.

You are a fantastic. Thanks for all your hard work
