Separation Agreements & Financial Settlements

Divorce may not always be at the forefront of your mind when a relationship breaks down. Nevertheless, there may be issues that you need to resolve sooner rather than later, which can be taken care of by making a separation agreement.

At Lupton Fawcett, we can assist you in reaching a settlement following separation. Upon reaching an agreement, we can incorporate what has been agreed into what is known as a deed of separation.

To speak to a solicitor for help with a separation, or for legal advice on what rights are, we are here for you. Get in touch today by calling our Yorkshire-based offices on 0333 323 5292, by sending us an email or by filling in our online enquiry form and letting us know when to get back to you.

What is a Separation Agreement?

A separation agreement is a legal document that represents any agreed arrangements between a couple on a number of issues, including living arrangements for children, financial matters or any other issues you wish to address. Although not currently legally binding in England and Wales, having a separation agreement drafted up makes it easier for you and your partner to understand what will happen if you should break up.

The Team

The family law team, based in Yorkshire, has years of experience working with individuals to help them achieve the best outcome in a separation. Whether you are looking for confidential legal advice, wishing to proceed with a separation or requiring assistance in dividing assets and property, we can help.

Separation Disputes

If divorce proceedings are issued at a later date, then the terms of the agreement can be incorporated into a consent order, which will need to be approved by the court. If there is any dispute, the court must weigh up a variety of factors, including whether you have had the benefit of independent legal advice regarding the terms of a deed prior to entering into any agreement with your partner.
