Acting for lenders
Our specialist team of commercial property solicitors regularly acts for lenders in a broad range of transactions and, on occasion, also acts for both the lender and the borrower at the same time.
Typically, a lender will want to be confident that their lending criteria has been satisfied and there are no issues that have arisen during our review of the property documentation, which may affect their security over the property. We will work towards finding a practical solution to any issues that are revealed by our due diligence exercise, in order to satisfy both the bank’s requirements and, if applicable, any practical issues that may concern the borrower.
Acting for borrowers
Not only can we provide help and advice for the lender, but we can also provide services to the borrower to make the process as smooth as possible. This may involve working on a single property deal, or alternatively advising in relation to the refinancing of a property portfolio consisting of multiple properties.
If acting for the borrower, we will ensure that they receive full advice in relation to the nature of the security documentation, including mortgages, debentures, guarantees and cross-guarantees, inter-creditor documentation and facility documentation. We know how important it is for you to get finance in place in a timely manner; our team is accustomed to working to strict time constraints, in particular to meeting facility deadlines.
