Legal Advice & Considerations when Starting a Family

Our family law solicitors in Leeds, Sheffield and York are here to help you negotiate the legal issues of starting a family, whether you do so as a married couple, unmarried parents, a single parent or through a process like IVF, sperm donation or adoption.

There are many, many different types of family unit  in the 21st century and each has subtly different legal procedures that should be followed, which is why our specialist family law advice is always tailored to your specific circumstances and your own hopes for the future.

Asserting your parental rights

First and foremost when starting a family, you need to know who has legal parental rights and the circumstances in which a biological parent may not receive those rights automatically.

This can be the case if, for example, a baby’s biological parents are not married and the father is not named on the birth certificate. In this scenario, the father would not automatically acquire legal parental responsibility

You may also enter into a long-term relationship with a partner who has children from a previous marriage or relationship – in this case if you want legal responsibility for those children, there are legal processes to go through that can grant this.

Doing so is not just for sentimental reasons, but also ensures that if something happens to your partner, you are a legal guardian to the child or children they leave behind.

Protecting your family’s future

You can protect your family’s financial future using things like private pensions and life insurance, but it’s important to protect their legal future too.

This can be done by making a Will that sets out provision for your children’s inheritance and how you want them to be cared for in the event of your death – including if there is a family member or close friend you would want to be their legal guardian if necessary.

It’s not always easy to think about what will happen after you are gone, but it’s an important part of the responsibility that comes with becoming a parent and you should make sure you regularly review your Will to check that it still accurately reflects your wishes.
